USG Privacy Policy

Introduction

USG Corporation ("USG," "us,” “our,” or “we”) respects the privacy of everyone we interact with. This Privacy Policy (“Policy”) explains how USG collects, uses, and discloses personal information, including through www.usg.com, www.plaster.com, or myusg.com (“Websites”), and offline services, such as call center activity (collectively, “Services”). USG refers to USG Corporation on behalf of itself and its affiliates, United States Gypsum Company, USG Interiors, LLC, USG Ceilings Plus, LLC, CGC Inc., and USG Mexico S.A. de C.V.

This Policy applies to interactions you may have with USG in your individual capacity or in your capacity as an employee, owner, director, officer, or independent contractor of another company, partnership, sole proprietorship, non-profit, or government agency (collectively, “Entity”).

As used in this Policy, “personal information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with individuals. Personal information does not include information that is publicly available or aggregated. Unless otherwise noted, the information in this Policy that describes how and why we collect, use, and disclose personal information also describes how and why we collected, used, and disclosed the personal information in the past 12 months.

Information We Collect and How We Use It

USG collects the following personal information from customers who purchase USG products, visitors who register on or make inquiries through our Websites, and vendors or suppliers of goods or services to USG (whether we collect a specific category of information about you depends on your interaction with us):

We also collect, use, or disclose the personal information described above for other purposes authorized by applicable laws, including:

  •  to conduct internal data analysis and product development;
  •  to comply with law enforcement requests or legal process;
  •  to detect, investigate, prevent, or otherwise address fraud or other security and integrity issues, or to maintain the security and integrity of our products and services, including investigating and responding to misconduct complaints;
  •  to exercise or defend against legal claims, including investigating those claims;
  •  to comply with applicable laws and regulations; or
  •  to form part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or transfer, divestiture, or sale of all or a portion of our business or assets.

Sources of Personal Information

We collect the personal information identified above from the following sources (whether we collected it from a specific source depends on the nature of your interaction with us):

  • Directly from you. We collect personal information from you when you provide it to us, such as in connection with a transaction, while interacting with our Websites, or when you call us or our call center.
  • Created by us. We collect personal information about you that we create, such as inferences generated from other information we collect.
  • Service providers. We collect personal information about you from certain service providers that provide information to help us run our business.
  • Affiliates. We share personal information among the companies within USG and its affiliates. We receive information from within USG and its affiliates, as permitted, to enable us to manage our business.
  • Law enforcement agencies, courts, regulatory agencies, and other government agencies. We may receive information from government agencies to comply with the law, to protect your personal safety or the safety of others, to protect our or others’ rights, or to investigate fraud.
  • Other parties. We may receive information about you from other parties when necessary to manage or operate our business. For example, in litigation settlements we may collect information about you from third parties related to our operational or tax reporting obligations.
  • Parties to corporate transactions. As permitted by law, we may receive personal information as part of a corporate transaction or proceeding, such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of a business or assets.

Information Automatically Collected. Our Websites use cookies, pixels, tags, trackers, and similar digital technologies to operate and to help collect data. Cookies are small text files placed on your device to store data that can be recalled by a web server in the same domain that placed the cookie. The text in a cookie often consists of a string of numbers and letters that uniquely identifies your device, but it can contain other information as well.

Cookies on our Websites are used to store your preferences and settings, help authenticate your USG account and enable you to sign in, provide interest-based advertising, combat fraud, analyze how our Websites perform, personalize your experience and the content you see on our Websites, and fulfill other business purposes.

Our Websites often include cookies, pixels, tags, trackers, and similar digital technologies from third-party vendors. In some cases, that is because we have hired the third party to provide services on our behalf, such as site analytics or advertising. In other cases, it is because our web pages contain third-party content (such as maps, plug-ins, or ads) that contain digital technologies used to track operability and performance of the content, as well as your interaction with the content to determine its effectiveness. When your browser connects to a third party’s web server to retrieve content and/or web beacons, that third party is able to set or read its own cookies on your device and may collect information about your online activities over time and across different websites or online services that also contain that third party’s content or web beacons.

For example, our Websites use third-party tools (such as Adobe and Google Analytics), to support the operation and performance of our Websites and to analyze your interactions and experiences with our Websites. We have implemented Google Analytics Advertising Features such as dynamic remarketing, interest-based advertising, audience targeting, behavioral reporting, demographics and interests reporting, user segment analysis, device reporting, display advertising, and impression reporting. We have implemented Google reCAPTCHA to protect our Websites from fraud and abuse. Your use of reCAPTCHA is subject to Google’s Privacy Policy at policies.google.com/privacy and Terms of Use at policies.google.com/terms.

We may offer third party integrations on our Websites. If you choose to connect a third-party account to our system, you should refer to that party’s privacy policy for information on how your personal data is collected, used, and protected.

Some of the vendors we work with offer tools that you can use to limit or opt out of their tracking technologies:

  • YouTube. YouTube API Services may collect, store, use, process and share personal information, including from your devices, as described in this Policy and to serve content. We are not responsible for the effectiveness of external parties’ opt out options or programs, or the accuracy of their statements regarding their programs. Note that opting out of these types of technologies may result in certain online features not functioning properly. In addition, using a tool to opt out of cross-context behavioral advertising may not opt you out of receiving contextual advertising.

Who We Disclose Personal Information To

We have disclosed, or may disclose, each category of personal information described above to these categories of recipients:

  • our service providers, whom we engage to assist us with technology support, operational support, and other forms of assistance, and whom we bind by contract to protect the confidentiality and security of the personal information we share with them;
  • our affiliated entities within the USG corporate family, for legally permissible purposes;
  •  the proposed or actual acquiring party or assignee in the event of a proposed or actual reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our company or its assets;
  • law enforcement agencies, courts, and government agencies when the disclosure is required or permitted by law, including to comply with valid legal process; or other parties as we believe to be appropriate and authorized by law, including: (i) when required by applicable law, including laws outside your country of residence; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities; (iv) to enforce the terms and conditions for use of our Services; (v) to protect and defend our rights and property; (vi) to protect the interests of USG or others; and (vii) to permit us to pursue available remedies or limit the damages that we may sustain.

Interest-Based Advertising

As noted above, on some pages of our Websites, we allow third-party advertising partners to use cookies and other digital technologies to collect or receive information regarding your activities on those web pages (e.g., your IP address, page(s) visited, time of day, and other identifiers). We may also disclose such information we have collected to advertising and analytics companies. These companies may use this information (and combine it with information collected over time and across other websites, apps, or other digital services) for purposes of delivering targeted advertisements to you, to provide measurement services about your interaction with our products, and when you interact with other (non-USG) websites and online services. This practice is commonly referred to as "interest-based advertising" or “online behavioral advertising”.

Retention

We keep the categories of personal information described above for as long as is necessary for the purposes described in this Policy or otherwise authorized by law.

This generally means holding the information for as long as one of the following criteria apply:

  • Your personal information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
  • Your personal information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the personal information was collected;
  • The personal information is reasonably required to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or
  • We are otherwise required or permitted to keep your personal information by applicable laws or regulations.

Your Choices

You have the right to submit certain requests relating to your personal information as described below.

  • Right to Know. You have the right to know what personal information we have collected about you, which includes:

o    The categories of personal information we have collected about you, including (a) the categories of sources from which the personal information was collected; (b) our business or commercial purposes for collecting personal information; (c) the categories of third parties to whom we disclose personal information; (d) the categories of personal information that we sold or shared, and for each category identified, the categories of third parties to whom we sold or shared that particular category of personal information; and (e) the categories of personal information that we disclosed for a business purpose and the categories of third parties to whom we disclosed each category of personal information.

o    The specific pieces of personal information we have collected about you.

  • Right to Delete Your Personal Information. You have the right to request that we delete personal information we collected from you, subject to certain exceptions.
  • Right to Correct Inaccurate Information. If you believe that personal information we maintain about you is inaccurate, you have the right to request that we correct that information.
  • Right to Opt Out of Sale, Targeted Advertising, and Profiling Using of Personal Information. You have the right to opt out of the sale of your personal information, use of your personal information for targeted advertising, and profiling, as applicable, in furtherance of decisions that produce legal or similarly significant effects. We do not profile in a manner that would result in legal or similarly significant effects, and as such do not offer this right.
  • Minnesota or Oregon Residents – Third Party Disclosures. If you live in Minnesota or Oregon, you also have the right to request a list of third parties to which we have disclosed personal information.
  • Delaware or Maryland Residents – Categories of Third Parties. If you live in Delaware or Maryland, you also have the right to request a list of the categories of third parties with whom we disclose your personal data

Submitting Requests. You may submit your requests to exercise your rights to us by:

Only you or an agent authorized to act on your behalf may make a verifiable request on your behalf. In addition, you may make a verifiable request on behalf of your minor child.

If we decline to act on your request, you may appeal our decision.

We will not discriminate against you for exercising your privacy rights.

Industry-wide opt-outs. Many advertising and analytics providers are members of associations, which provide a simple way to opt out of analytics and ad targeting, which you can access at:

Mobile advertising ID controls. Apple and Android mobile devices each generate an advertising identifier that can be accessed by apps and used by advertisers in much the same way that cookies are used on websites. Each operating system provides options to limit tracking and/or reset the advertising ID.

Browser controls. Web browsers vary on whether they are set to accept or allow various types of cookies and similar digital technologies by default. You can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies and similar digital technologies, this could affect certain features or services of our Websites. If you choose to delete digital technologies, settings and preferences controlled by those digital technologies, including advertising preferences, may be deleted and may need to be recreated.

Do Not Track. Some browsers have incorporated “Do Not Track” (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Websites do not currently respond to browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described above.

Information from Children Under Sixteen

Our Websites are not targeted to children under the age of 16, and we do not knowingly request personal information from any child under the age of 16 without parental consent. When we do receive such information, we delete it as soon as we discover it and do not use it or share it with third parties.

Additional Notices to California Residents

This section provides additional disclosures and describes additional rights applicable to residents of California under the California Consumer Privacy Act ("CCPA"), as amended. Capitalized terms in this section have the same meaning as the matching terms defined in the CCPA.

We do not Collect Sensitive Personal Information for the purpose of inferring characteristics about you. We do not use or disclose Sensitive Personal Information for purposes to which the Right to Limit Use and Disclosure applies under the CCPA.

We Sell and Share Personal Information to deliver personalized advertisements on our Websites and other websites you may visit. We do not otherwise Sell or Share Personal Information.

Minors. We do not knowingly Sell Personal Information of minors under 16 years of age.

Links to Other Websites

We may link to other websites. Please be aware that we are not responsible for the privacy practices of such other websites. We encourage our users to read the privacy statements of each and every website that they visit.

International Visitors

If you live outside the United States (including in the European Economic Area (“EE”) and Switzerland (“CH”) collectively the “EEA/CH”), and you use our Websites or provide us with your personal information directly via our Websites, your information will be handled in accordance with this Policy. By using our Websites or giving us your personal information, you are directly transferring your personal information to us in the United States. You are solely responsible for compliance with any data protection or privacy obligations in your jurisdiction when you use our Websites or provide us with your personal information. Regardless of where we transfer your information, we still protect your information in the manner described in this Policy.

Notification of Changes

If we decide to change our Policy, we will change the “Effective Date” at the top of this Policy. We will use information in accordance with the privacy policy under which the information was collected.
